The terms that apply when purchasing or using services provided by Bold North Agency.
BR Digital Solutions Ltd Trading as Bold North Agency Terms of Service
These Terms of Service apply to services supplied by BR Digital Solutions Ltd, trading as Bold North Agency.
By purchasing a service, accepting a proposal, instructing us to begin work or otherwise entering into an agreement with Bold North Agency, you agree to the terms applicable to that service.
Where a written proposal, quotation, order confirmation, statement of work or service agreement is provided, that document forms part of the agreement between you and Bold North Agency.
Where project-specific terms differ from these general Terms of Service, the project-specific terms will take priority for that engagement.
1. About Bold North Agency
Bold North Agency provides professional digital services to businesses across areas including commercial web infrastructure, website design and development, Webflow, Shopify and ecommerce, website audits, search and digital growth, SEO, GEO and AI search visibility, digital strategy, automation, CRM implementation, integrations, portals, dashboards, bespoke software and related consultancy.

2. Services
The exact scope of work will depend on the service purchased or the proposal agreed with you.
Where a written proposal, quotation, order confirmation, statement of work or service description is provided, that document forms part of the agreement between you and Bold North Agency.
We will provide our services with reasonable care and skill.
Work requested outside an agreed scope may require additional fees, a revised quotation or a separate project.
3. Website Growth Deep Dive
The Website Growth Deep Dive is a tailored professional review of your website and wider online presence.
Depending on the business and website being reviewed, this may include areas such as:
The exact checks used may vary depending on what is relevant to your business.
The Deep Dive includes an expert review, prioritised recommendations, an action plan and a 30-minute review call.
4. Pricing and Payment
Pricing and payment terms will be confirmed before work begins.
Website projects may be paid in full before work begins or split into two payments, with 50% due before work begins and the remaining 50% due on completion.
Bespoke software, ecommerce, automation, integration and other custom digital projects may use different staged payment schedules depending on scope and complexity. Any such payment schedule will be confirmed in the relevant proposal or service agreement.
Ongoing services and retainers are normally billed according to the billing cycle stated in the relevant proposal, order confirmation or service agreement.
The Website Growth Deep Dive is currently priced at £199 as a one-time payment.
Bold North Agency is not currently VAT registered, so VAT is not added to prices unless our VAT status changes and applicable documentation states otherwise.
Payment may be processed using a third-party payment provider such as Stripe or by another payment method agreed with Bold North Agency.
You are responsible for ensuring that the payment, billing and contact information you provide is accurate.
5. Service Availability
Bold North Agency primarily provides services to businesses in the United Kingdom.
Certain products or services, including the Website Growth Deep Dive, may be restricted to particular locations or customer types.
We may refuse or cancel an order where a service has been purchased by a customer outside the supported service area or where we cannot reasonably provide the service.
Where payment has been taken and a service cannot be provided, any applicable refund will be handled in accordance with our Refund & Cancellation Policy .
6. Starting Work
Work may begin once the required initial payment has been received and the information, materials or access reasonably required to provide the service have been supplied.
You agree to provide accurate and sufficient information about your business, website, systems and online presence where reasonably required.
Delays in providing requested information, access, approvals or materials may delay delivery.
7. Delivery and Project Timelines
Reports, recommendations and other digital deliverables will normally be provided electronically.
Website, software, ecommerce, automation and other implementation projects will be delivered according to the process and scope agreed for that engagement.
Any stated delivery date, launch date or turnaround time is an estimate unless specifically agreed otherwise in writing.
Bold North Agency is not responsible for delays caused by missing customer information, delayed approvals, third-party services or matters outside our reasonable control.
8. Review and Consultation Calls
Where a service includes a review or consultation call, you will be provided with a method to book or arrange the call.
If you cannot attend, you should reschedule using the booking system or instructions provided.
A missed review call does not automatically entitle you to a refund where the underlying service has already been completed.
9. £99 Deep Dive Project Credit
Where stated as part of the Website Growth Deep Dive offer, customers who proceed with an eligible larger Bold North Agency project within 30 days of purchasing the Deep Dive may receive £99 credit towards that project.
A project is considered booked once the relevant proposal has been accepted and any required initial payment has been received.

10. Refunds and Cancellations
Refunds and cancellations are handled in accordance with our separate Refund & Cancellation Policy .
Where bespoke work, research, strategy, analysis, design, development or other service delivery has already started or been completed, refunds may be limited or unavailable, subject to the agreed terms and applicable law.
Nothing in these Terms affects rights that cannot legally be excluded.

Bold North Agency provides professional strategy, advice, implementation, analysis and recommendations based on the information available and the agreed scope of work.
We do not guarantee specific search rankings, traffic levels, lead volumes, revenue increases, conversion rates, advertising results, AI visibility or other commercial outcomes.
Search engines, AI platforms, advertising platforms, social networks and other third-party services may change their systems, algorithms, products and policies without notice.
Recommendations, forecasts and strategies are therefore professional guidance and not guarantees of a particular outcome.
13. Third-Party Services
Our services may reference, integrate with or depend on third-party platforms and providers such as Google, Stripe, Shopify, Webflow, CRM systems, hosting providers, advertising platforms, analytics services, social networks, APIs and software tools.
Bold North Agency is not responsible for the availability, pricing, policies, algorithms, security, functionality or performance of third-party services outside our reasonable control.
Where a third-party service changes, is withdrawn or becomes incompatible, additional work may be required to adapt an existing solution.
14. Intellectual Property
Unless otherwise agreed in writing, Bold North Agency retains ownership of its underlying methods, processes, reusable systems, know-how, templates, frameworks and pre-existing materials.
Rights relating to final project-specific deliverables will be governed by the relevant proposal or service agreement where applicable.
Once full payment has been received, you may use final reports, recommendations and other deliverables supplied specifically for your business for the purposes agreed.
You may not resell, reproduce commercially or distribute Bold North Agency proprietary materials without permission.
15. Confidentiality
Both parties should treat confidential business information received during an engagement as confidential.
Bold North Agency will not intentionally disclose confidential customer information to third parties except where reasonably required to provide the service, use an authorised service provider or comply with legal obligations.
16. Data Protection
Personal information is handled in accordance with our Privacy Policy .
Where third-party services are used to provide a service, information may also be processed in accordance with those providers' applicable privacy terms.
17. Limitation of Liability
To the extent permitted by law, Bold North Agency will not be liable for indirect or consequential losses, loss of profit, loss of revenue, loss of anticipated savings, loss of business opportunity or losses caused by third-party platforms or services outside our reasonable control.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
For business customers, where liability can legally be limited, our total liability relating to a specific service will not normally exceed the amount paid to Bold North Agency for that service.
18. Suspension or Refusal of Service
Bold North Agency may refuse, suspend or terminate a service where:

19. Ongoing Services and Retainers
Ongoing services may include SEO, digital marketing, website optimisation, automation, technical support, maintenance and other agreed growth activity.
The applicable scope, billing cycle, minimum term and cancellation notice period will be stated in the relevant proposal, order confirmation or service agreement.
Work requested outside the agreed recurring scope may be charged separately where this has been agreed with the customer.
20. Changes to These Terms
We may update these Terms from time to time.
The version applicable to a purchase or project will normally be the version in effect when the relevant service was purchased or agreed, unless a later change is required by law or agreed with you.
21. Governing Law
These Terms are governed by the laws of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, unless applicable law provides otherwise.
